I understand that “Pet” means the animal described above, who is the subject of this adoption agreement.(Required)

I understand that this adoption is a lifetime commitment to the pet and I will do everything within my power to care for the pet to ensure its optimum health, safety, and happiness. I agree Pet shall not be euthanized for non-medical reasons.(Required)

If behavioral issues arise that I cannot resolve, I agree to hire a licensed professional trainer and work with the Pet to solve the issues. I will not surrender the Pet to a shelter before contacting Animal Rescue of the Rockies to discuss the situation.(Required)

I understand that if I am unable to care for the Pet, I will contact Animal Rescue of the Rockies immediately. I agree that I am then bound to return the pet to Animal Rescue of the Rockies and may not transfer ownership or possession to any other party without prior approval of Animal Rescue of the Rockies. If I attempt to wrongfully transfer ownership or possession of the animal such an act will be determined to be a breach of this contract subject to the terms and conditions described therein. I hereby acknowledge the Pet shall not be sold, given to, or adopted to anyone else, nor shall there be any transfer of ownership to any firm, corporation, or any other individuals, humane association, animal shelter, animal control facility, medical/experimental laboratory, or any other organization, or as part of any criminal plea agreement. The Pet must be returned to Animal Rescue of the Rockies if for any reason I no longer wish to keep it. Violation of this agreement will result in court costs and attorney fees payable by me if necessary for Animal Rescue of the Rockies to redeem the Pet, as well as damages for the monetary value of the Pet as determined by this contract. I understand that Animal Rescue of the Rockies has limited placements and can only take back the Pet if Animal Rescue of the Rockies has the resources and capability to do so. It can take weeks or months before an alternate placement for the Pet can be found, however, I agree to work with Animal Rescue of the Rockies in order to find a placement for the pet. I understand I will be responsible for all boarding costs for the Pet if I request that the Pet be immediately removed from my household.(Required)

I acknowledge that the Pet is adopted “as is” and that no implied or expressed warranties have been made by Animal Rescue of the Rockies in reference to breed, health, training or temperament of the Pet. Animal Rescue of the Rockies has provided all information it has about the Pet, including any vaccination or veterinary records but cannot certify to the completeness or accuracy of such documentation. I understand that any description of the Pet’s breed is a guess, and I have been advised to have DNA testing done at my expense prior to adoption if I live in an area with breed restrictions. I will be provided with a copy of the Pet's records at the time of adoption if available OR as soon as Animal Rescue of the Rockies receives the records from the veterinarian after adoption. I acknowledge that the Pet’s known background and medical history have been discussed with me. I understand that Animal Rescue of the Rockies has made no representation concerning the health, condition, training, behavior, or temperament of the Pet.(Required)

I understand that Animal Rescue of the Rockies strongly urges Adopter to exercise prudence and caution in introducing the Pet into a new situation (for example dog parks, stores, groomer, vet, other homes and meeting other animals) until the Pet has become fully adjusted to its new environment and Adopter has had an opportunity to become familiar with the Pet’s unique personality. I accept all responsibility and liability for all interactions with people and other animals. Animal Rescue of the Rockies is available to assist with recommendations for behavioral training, veterinary referrals, and other resources. Adopter will be responsible for any associated costs.(Required)

I agree to provide the Pet with the necessary vaccinations and provide all necessary medical treatments as advised by my veterinarian. I agree to obtain immediate veterinary care should the pet become sick or injured, and to take full financial responsibility for such veterinary expenses. I acknowledge that I am responsible for veterinarian and medical expenses upon adoption of the Pet and that Animal Rescue of the Rockies is not financially responsible for any expenses after adoption.(Required)

I understand that all pets adopted from Animal Rescue of the Rockies are spayed or neutered prior to adoption. Exceptions are made only if the pet’s life or health would be adversely affected according to a licensed veterinarian.(Required)

If an exception is needed for the previous agreement, please explain:

I agree the Pet will be kept as an indoor pet and agree to allow it full access to my home. I agree to provide the Pet with fresh water, wholesome food, adequate exercise, and affection. I will always provide the Pet with a fenced yard at the home where the Pet will be, or I understand that I must demonstrate to Animal Rescue of the Rockies an ability to properly exercise and keep the Pet safe while going to the bathroom. I agree never to allow the Pet to run loose in an unfenced area. I agree never to tie up or chain the Pet or to allow it to ride uncaged in the back of a pick-up truck or open vehicle.(Required)

I will ensure compliance with all applicable local, state, or federal ordinances or statutes regarding possession and ownership of the Pet. If I am charged with violating any such ordinance or statute while in possession of the Pet, I understand Animal Rescue of the Rockies is not responsible for obtaining legal counsel for me or for paying any fines or penalties assessed.(Required)

If the pet is a cat, I shall NEVER declaw the cat under any circumstances. I understand that declawing is the painful amputation of the first knuckle, which renders the pet defenseless and inflicts unnecessary pain.(Required)

If the pet is a dog, I agree NEVER to debark, defang, or crop the ears or tail of the dog under any circumstances.(Required)

I affirm that no member of my household has been convicted or charged with any animal welfare law violation such as hoarding, unsanitary conditions, neglect, cruelty, abandonment, etc. I affirm that no member of my household has been convicted or charged with any domestic battery or sex crime.(Required)

I will not abuse or neglect the Pet or allow it to be abused or neglected. I authorize Animal Rescue of the Rockies, at its sole discretion, to determine whether or not the Pet has been abused or neglected while in my possession. In the event that Animal Rescue of the Rockies determines that abuse or neglect has occurred, I authorize Animal Rescue of the Rockies to declare this agreement in breach and to reclaim the pet at its sole discretion.(Required)

I will not use a prong collar or shock collar at any time. I will attach a personal identification tag to a collar or harness to be worn at all times(Required)

IMPORTANT: I agree to use a harness for all small dogs and a martingale-style collar for all dogs over 40 lbs. I understand that I must bring an appropriate Martingale-style collar or harness with me to the adoption pick up in order for the dog to go home. (We've had too many escapees and lost dogs right after adoption who have slipped out of their regular collars.)(Required)

I agree that the Pet’s microchip will remain with Animal Rescue of the Rockies’ contact information (address, phone number, or email address). I agree not to remove or alter Animal Rescue of the Rockies’ contact information from the Pet’s microchip. I understand my contact information will be added by Animal Rescue of the Rockies to the pet’s microchip information. In the event the microchip stops working (backs out after implantation, microchip cannot be found with a microchip scanner, etc.), I agree to notify Animal Rescue of the Rockies without delay so that a new microchip can be implanted.(Required)

In the event the Pet becomes lost; I will immediately notify Animal Rescue of the Rockies. I will immediately notify the Rescue of any change of contact information (address, phone number(s), or email address). I authorize any individual or agency to release the Pet back to Animal Rescue of the Rockies if the Pet is found abandoned, running at large or is brought to a shelter facility for any reason. I agree that, at Animal Rescue of the Rockies’ sole discretion, Animal Rescue of the Rockies may retain possession of the Pet and reclaim ownership of the Pet if the Pet became lost through a breach of this agreement.(Required)

I understand that the Pet shall not participate or be trained as a guard dog or fighting dog. I will not allow any physical, mental, or emotional abuse of the Pet.(Required)

I will not leave the Pet unattended with small children.(Required)

I affirm that if I rent, I have the permission of my landlord to adopt this Pet. I agree to pay any pet deposit or pet rent required to keep my pet.(Required)

I affirm that all the members of my household agree with the decision to adopt the Pet and will treat the Pet as a family member.(Required)

I will ensure compliance with all applicable local ordinances and state statutes regarding ownership of Pet. If I am charged with violating any such ordinance or statute while in possession of Pet, I understand that Rescue is not responsible for obtaining legal counsel for me or for paying any fines or penalties assessed.(Required)

I am taking possession of Pet at my own risk, and I release Rescue, its officers, directors, members, employees, representatives, agents or assigns from any and all liability arising out of possession of Pet. I understand I am the legal owner and party responsible for the Pet’s actions. I adopt the Pet at my own risk. I agree to assume full responsibility for the conduct of the Pet. I further agree to release, indemnify, and hold harmless Animal Rescue of the Rockies and its representatives, including its Board of Directors and Volunteers, and to indemnify such organizations or individuals from any damages, costs, or injuries resulting from liability, known or unknown, anticipated or unanticipated, as a result of the Pet’s conduct.(Required)

I understand and agree that upon completion of the adoption process, I am solely responsible for damage, illnesses, or diseases and/or injuries caused by the Pet. I understand that if the Pet bites or injures any human or other animal, I will hold harmless and indemnify Animal Rescue of the Rockies from any claim or suit filed by anyone as a result of such an incident.(Required)

I acknowledge and agree to notify Animal Rescue of the Rockies of any criminal complaint, summons, indictment or other violation of law brought against me involving the Pet. I further agree to notify any relevant animal control facility, municipality, county, state government, district attorney, prosecutor, or other individual, organization, or enforcement agency, holding, detaining, or impounding the Pet of my contractual obligations with Animal Rescue of the Rockies that preclude surrender of Pet. I agree to cooperate with Animal Rescue of the Rockies and law enforcement to ensure the return of the Pet to Animal Rescue of the Rockies if in the best interest of the Pet and public health and safety. I will not offer to surrender the Pet to law enforcement for permanent forfeiture or voluntary euthanasia request and will instead direct law enforcement to attempt to coordinate return of the Pet to Animal Rescue of the Rockies(Required)

I acknowledge the Pet’s known background and medical history have been discussed with me. I understand that Animal Rescue of the Rockies has made no representation concerning the health, condition, training, behavior, or temperament of the Pet.(Required)

I agree Rescue will not be held liable for any damage or loss resulting from the failure of the Pet to respond to any commands taught to the Pet or resulting from counseling advice supplied to Adopter. In the event any behavioral concerns arise, Adopter will immediately notify Animal Rescue of the Rockies. Should any behavior of the Pet result in damage to property, Adopter, or another person or animal while in the possession of Adopter, Adopter agrees to assume full liability to such third party for any and all such damage, and indemnify Rescue from any and all such damage to third party.(Required)

I agree Rescue shall not be responsible for any bodily injuries or property damage and/or damage to other animals caused by the Pet or by the actions of Adopter. The Adopter hereby specifically assumes sole responsibility for, and agrees to indemnify and hold Animal Rescue of the Rockies and its officers, directors, members, employees, representatives, agents or assigns harmless from any and all loss and expenses (including legal fees) for any reason imposed upon Animal Rescue of the Rockies or any of its officers, directors, members, employees, representatives, agents, or assigns because of bodily injuries or death to any person or persons including Adopter or those in Adopter’s household, or any damage to property and/or animals arising out of or in consequence of the placement of Pet howsoever such injuries, death or damage to property and/or animals may be caused, whether or not the same may have been caused, or may be alleged to have been caused, by negligence of the aforementioned parties or any of their directors, members, employees, representatives, agents, or assigns or any other person.(Required)

I acknowledge and agree that animal bites or other injuries to humans and other animals do occur and that all animals can carry and transmit parasites, diseases, including zoonotic diseases that can be transferred from animals to humans. I agree that Animal Rescue of the Rockies is not responsible for the transmission or transfer of any disease or parasite to other animals or people in the adopting household, and I agree to hold Animal Rescue of the Rockies blameless.(Required)

I agree to allow Animal Rescue of the Rockies to conduct a home visit within one week of adoption. In the event the home is deemed unsuitable for the Pet, I agree to surrender the Pet back to Animal Rescue of the Rockies.(Required)

I acknowledge failure to comply with any of the adoption contract requirements constitutes grounds for Animal Rescue of the Rockies to deem this contract in breach and reclaim the adopted Pet. Animal Rescue of the Rockies will provide Adopter of written notice to his/her last known address in the event it believes any term or condition of this Agreement has been breached. I agree to voluntarily surrender the Pet to Animal Rescue of the Rockies within 24 hours of receipt of such notice, making no charges of any nature for licensing, care, food, or any other services.(Required)

I agree that any legal action pertaining to this agreement shall be heard in Denver County Court (or its small claims division), Colorado. In the event Rescue has to file a replevin action to recover possession of the Pet, I voluntarily waive my right to attend a show cause hearing under Colorado Rule of Civil Procedure 101 or 401 and agree that the Court has the authority to issue a pre-judgement order of possession of the Pet to Animal Rescue of the Rockies without the necessity of posting a bond.(Required)

I acknowledge that breach of this agreement will result in travel costs, court costs and attorney fees payable by me if legal action or travel is necessary for Rescue to recover Pet. I understand that the Pet has intrinsic value and is not replaceable, so if the Pet is altered in any way prohibited by Paragraph 8, euthanized, lost or otherwise unable to be returned to the Rescue due to the negligence or intent of Adopter to circumvent Rescue’s right to re-possess Pet, I will be in breach of this agreement and will be subject to pay liquidated damages to the Rescue in the amount of $2,500.00 in addition to all attorney's fees and costs and actual damages incurred as a result of the breach.(Required)

I acknowledge Animal Rescue of the Rockies shall be entitled to all attorney fees and costs incurred in any legal action brought by either party as a result of my adoption of the Pet or any alleged breach of any of the terms of this agreement.(Required)

Any violation of the terms of this agreement shall be grounds for immediate termination of the Adoption Agreement, and the Pet shall be immediately surrendered to Animal Rescue of the Rockies.(Required)

I understand that if I am found to have materially misrepresented any fact or portion of my adoption application, this contract is materially breached, and Animal Rescue of the Rockies may demand the return of the Pet(s). I understand that if I am found to have materially misrepresented any fact or portion of my application, I agree to pay any and all costs and fees associated with the return of the Pet(s) to Animal Rescue of the Rockies, including attorney fees.(Required)

Any additional terms are set forth herein:

I understand that by voluntarily signing this agreement, I am entering into a legal and binding contract with Animal Rescue of the Rockies. I understand that any misrepresentations in my application or failure to abide by any of the terms of this agreement are cause for Animal Rescue of the Rockies to declare this agreement in breach and notify me of its intention to reclaim the Pet.(Required)

The Representations contained in the Adoption Application are incorporated herein by reference, and Animal Rescue of the Rockies is relying on those representations in entering into this Agreement. This Agreement is the entire agreement between Animal Rescue of the Rockies and Adopter, and supersedes any prior understandings between the parties with respect to the subject matter of this Agreement.(Required)

No modification of this Agreement will be valid unless in writing and duly signed by Animal Rescue of the Rockies and the Adopter. This Agreement is binding upon the heirs, assigns, successors, personal representatives, and executors of both parties.(Required)

Please note:  No adoption is final until the pet is spayed or neutered and the adoption fee has been paid.  A home visit needs to be completed and approved within 1 week of adoption.  If the home visit is not approved, ARR reserves the right to take the pet back into our care for the pet’s safety.
